Elegant Legal Writing Privacy Policy

This Privacy Policy describes how Elegant Legal Writing (“ELW,” “we,” or “us”), may collect and use personal information when you access the ELW website, subscribe to its publications, register for an ELW event, make an ELW purchase, participate in an ELW program, or communicate with us.

The Elegant Legal Writing website is hosted by Substack. Substack also collects and processes information under its own Privacy Policy. This Policy describes ELW’s practices and should be read together with the ELW Terms of Service and Substack’s policies.

1. Information you provide

We aim to avoid collecting sensitive or personally identifying information about our users any more than we must to effectively provide our services. We may collect information that you choose to provide, including your name, email address, organization, registration selections, transaction information, survey responses, workshop contributions, and communications with us.

Payments are processed through Stripe. Stripe collects payment-card and related payment information under its own privacy policy. ELW receives information needed to confirm and administer a purchase, such as the purchaser’s name, email address (if supplied), organization (if supplied), amount paid, payment status, and transaction identifier. ELW does not receive or store full payment-card numbers or addresses.

When you participate in a workshop or course, education and communication platforms such as Zoom, Google Docs, Dropbox, or others may collect your account or display name, email address, device and connection information, and activity on that service when you use it. Material that you place in a shared document, chat, or live session may be visible to ELW personnel and other attendees. Never submit or share (with other participants or us) client identifiers, privileged material, personal data, trade secrets, or other confidential or sensitive information of any kind.

The website and its service providers may automatically collect information such as your IP address, approximate location, browser and device information, referring page, pages viewed, and interactions with the website. Substack provides website and publication analytics. ELW may also use Google Analytics, which uses cookies or similar identifiers to measure website use.

2. How we use information

We may use personal information to:

  • operate the website and publications;

  • process and administer purchases, registrations, refunds, and transfers;

  • communicate about programs, purchases, and participation;

  • provide workshops, course materials, and related services that you request;

  • respond to your questions and requests;

  • understand and improve our website, publications, programs, and marketing;

  • maintain security, prevent fraud or misuse, and enforce our Terms of Service; and

  • comply with legal, tax, accounting, and regulatory obligations.

We send promotional email only through a subscription or other permission-based process. You may unsubscribe through the link in any promotional email. Transactional or program-related messages may still be necessary to fulfill a purchase or registration.

3. How we may disclose information

We never sell personal information or knowingly share it with third-party advertisers. We disclose personal information only as reasonably necessary for the purposes described in this Policy and to provide services you request. This may require disclosing information to service providers that host the website, process payments, provide analytics, deliver email, host video conferences or shared documents, store records, or support ELW operations. These providers may include (without limitation) Substack, Stripe, Google, LearnWorlds, and Zoom, each of which processes information under its own terms and privacy practices.

Information that you contribute during an interactive program may be visible to other attendees. The ELW Terms of Service require attendees to respect one another’s privacy and prohibit unauthorized recording or distribution, but we have no practical ability to monitor attendees’ compliance with these Terms or control over what they do, so you may wish to participate in a workshop anonymously or, if not anonymously, at your own risk.

We may also disclose information when reasonably necessary to comply with law or legal process; protect ELW, participants, or others; investigate fraud, security problems, or violations of our Terms; or complete a sale or transfer of all or part of the ELW business.

ELW does not sell personal information, rent mailing lists, or disclose registration information to data brokers. ELW does not use registration information for targeted advertising.

4. Cookies and analytics

Substack and Google Analytics may use cookies or similar technologies to distinguish visitors, measure sessions and interactions, and generate reports about website use. These services may collect information over time and across websites under their own privacy policies.

If Google Analytics is enabled, Google may collect and process information about your use of the website as described in How Google uses information from sites or apps that use our services. You may be able to opt out using the Google Analytics Opt-out Browser Add-on.

You can control or delete cookies through your browser and any cookie controls that the website makes available. Disabling cookies may affect website functionality.

5. Recordings and shared materials

ELW does not ordinarily record live workshops. If ELW plans to record a session, we will provide notice before recording and get any consent required by law. Participants may not record, photograph, screenshot, transcribe, or otherwise capture a session, as explained in the ELW Terms of Service.

Shared workshop documents may remain available for a limited period after a session or may be retained as part of ELW’s program records. Avoid including information that you do not want ELW personnel or other attendees to see.

6. Retention and security

We retain personal information only as long as reasonably necessary to provide services, maintain business and transaction records, comply with legal, tax, accounting, or regulatory obligations, resolve disputes, and enforce agreements.

We use reasonable administrative, technical, and organizational measures to protect personal information. No system or transmission method is completely secure, and we cannot guarantee absolute security.

7. Your choices and requests

You may request access to, correction of, or deletion of personal information held directly by ELW by emailing elw@rushingmccarl.com. We may need to verify your identity and may keep information when required or permitted by law. Requests concerning information controlled by Substack, Stripe, Google, Zoom, or another provider should also be directed to that provider.

Depending on where you live, applicable law may provide additional privacy rights. We will respond to valid requests as required by applicable law.

8. Children

ELW’s website, publications, and programs are not directed to children under 16, and ELW does not knowingly collect personal information from children under 16.

9. Changes to this Policy

We may revise this Policy occasionally. We will post the revised Policy and update its effective date. If a change is material, we may also provide notice through the website or by email when appropriate.
